3.1 Credit System

Our service operates on a credit-based system:

  • Credits are purchased in packages or through subscriptions
  • Credits are consumed when generating videos
  • Credits expire according to their package terms (typically 30-365 days)
  • All credit purchases are non-refundable except as required by law

3.2 Video Generation

When generating videos, you agree that:

  • You own or have the right to use all input content (images, prompts)
  • Generated videos comply with our content policies
  • We cannot guarantee specific output results
  • Generation times vary based on demand and complexity

4. Acceptable Use Policy

You agree NOT to use our service to:

  • Generate illegal, harmful, or defamatory content
  • Infringe on intellectual property rights
  • Create deepfakes or misleading content without disclosure
  • Violate any applicable laws or regulations
  • Attempt to circumvent credit limits or payment systems
  • Reverse engineer or attempt to extract our AI models
  • Spread malware or viruses through our service

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of content you provide. By using our service, you grant us a license to:

  • Store and process your content for video generation
  • Display generated results on our platform
  • Use your content to improve our AI models (in anonymized form)

5.2 Generated Content

You own the videos generated using your credits. However:

  • You must comply with all applicable laws when using generated content
  • We are not responsible for how you use generated videos
  • AI-generated content may not be copyrightable in some jurisdictions

5.3 Our Platform

All content on our platform (text, design, code, trademarks) is protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our proprietary content
  • Use our branding without permission
  • Scrape or extract data from our platform

6. Payment and Billing

6.1 Credit Packages

  • Credit packages are one-time purchases with no automatic renewal
  • Credits expire as specified in the package description
  • Purchased credits are non-refundable

6.2 Subscriptions

  • Subscription plans automatically renew monthly or yearly
  • You can cancel anytime; cancellations take effect at the next billing period
  • Prices may change with 30 days notice

6.3 Payment Processing

Payments are processed through third-party providers (Creem). We do not store your payment card details. By providing payment information, you agree to the provider's terms as well.

7. Disclaimer of Warranties

Our service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF GENERATED CONTENT

We do not guarantee:

  • Uninterrupted or error-free operation
  • That generated content will meet your specific requirements
  • The platform will be available at all times

8. Limitation of Liability

To the fullest extent permitted by law, Creatai Demo shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, business opportunities, or goodwill
  • Cost of procurement of substitute goods or services
  • Damages resulting from inability to use our service

Our total liability for any claim shall not exceed the amount you paid to us in the six months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless Creatai Demo from:

  • Any claims arising from your use of our service
  • Any violations of these Terms by you
  • Any misuse of generated content you create
  • Any third-party claims related to your content

10. Content Moderation

We reserve the right to:

  • Suspend or terminate accounts that violate these Terms
  • Cooperate with law enforcement requests
  • Report illegal content to authorities

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users or our business
  • Violates applicable laws

Upon termination:

  • Your right to use the service ends immediately
  • We may delete your account data
  • Sections 8, 9, and 10 shall survive termination

12. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved in accordance with our dispute resolution provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our service after changes constitutes acceptance of the new Terms.
